The law is a set of rules for society, designed to protect basic rights and freedoms, and to treat everyone fairly. These rules can be divided into two basic categories: public law and private law. Public law deals with matters that affect society as a whole. It includes areas of the law known as criminal, constitutional and administrative law. They deal with the relationship between the individual and the state. If someone breaks a criminal law, it is regarded as a wrong against society as a whole, and the state takes steps to prosecute the offender. Private law deals with relationship between individuals in society and is used primarily to settle private disputes. When one individual sues another over some private dispute, this is a matter for private law. Private suits are also called “civil” suits. Laws must be enforced, interpreted and applied if they are to be effective, and the legal system includes a number of institutions to carry out these duties. Police forces enforce the law. Courts interpret both public and private law in specific cases and impose remedies, “sanctions” or penalties. What is law?

Civil law. The claimant typically seeks relief from the court in the form of a declaration that the defendant has breached a legal duty, as well as a remedy. If the claimant has sought damages, the court decides whether the claimant is entitled to damages and then decides the amount. If the damages assessment is complicated, the court can order an inquiry into damages.Where the claimant has sought an injunction, for example, preventing the defendant from trespassing on the claimant's property, the court must decide what is an appropriate remedy, if any, and the precise terms of it.When judgment has been delivered, the judge must deal with costs of the case, which may include the fees of any lawyers, court fees, fees of expert witnesses, allowances for litigants in person, lost earnings and travel expenses of the parties and their witnesses. The general rule is that the losing party must pay the costs of the successful party but the court has discretion on the cost award that it can make. The judge can hear representations about this at the end of the case or in a separate cost hearing.Criminal law. The verdict can be either "not guilty" or "guilty". There are two classes of lawyers in England and Wales — barristers and solicitors. In England and Wales most law students become solicitors. When they finish their university studies, which usually take three years, they do a one year legal practice course and then a two-year training contract with a law firm. After that, they are qualified solicitors. Many solicitors work for a legal practice, which is usually a partnership of solicitors who work together. Solicitors practice in many areas of law, although each solicitor usually chooses to specialize in one particular area. They represent their clients both in and out of court, which is often described as “acting for a client”. Solicitors are lawyers who take legal business for ordinary people. They give advice to non-professional clients and prepare all the necessary documents for the barrister.Barristers are self-employed lawyers and don’t work in partnerships in the way that solicitors do. They are specialists in advocacy, which is the skill of speaking for someone in court, called “pleading a case”. They also give opinions on areas of law to solicitors and the solicitors’ clients. It is not just barristers who have the right of audience in court – solicitors are also allowed to represent their clients in court and many solicitors appear in court every day. It is not true to say that a client always needs a barrister in court. Still, it's the barrister who conducts the case in the higher courts. Educational standard for barrister is really high. A barrister must pass the special legal exams and become a member of a legal corporation called «Inn of Court». All barristers are either «juniors» or «King's (Queen's)». When a barrister becomes Q.C. he «takes silk». It means that he can wear a silk gown. Participating in a trial, a barrister may be counsel for the plaintiff (counsel for the prosecution) or counsel for the defendant (counsel for the defense).

Civil cases. The main function of the trial is for the judge to hear the evidence and decide on the claim. The parties may have agreed some important facts or preliminary issues before trial. These issues may concern the law to be applied or the terms of the judgment to be given, but usually written and oral evidence will be given by the parties and their witnesses and live witnesses may be cross-examined. Factual and expert witnesses are generally called to give evidence at trial. Their written statements tend to stand as evidence-in-chief, so they do not need to give oral evidence on the matters contained in their witness statements. Criminal cases. The function of the trial is for the Crown to present and prove their case and for the defense to argue for an acquittal or conviction on a lesser charge. Where the defendant enters a guilty/no contest plea the judge is informed in advance. If the judge accepts the plea he or she hears the plea in open court so that it forms part of the record. The defendant is then sentenced. The judge plays an active role in the trial, controlling the way the case is conducted. In both the Crown Court and Magistrates' Court, advocates prosecute the case on behalf of the Crown. The defendant has his or her own legal representative in court to defend him or her against the charges.

The United Kingdom (the UK) has three separate legal systems: one each for England and Wales, Scotland and Northern Ireland. This reflects its historical origins. The UK has an unwritten constitution in that there is no single written document that sets out the rights of individual citizens and how the Government should act. The UK constitution is comprised of a variety of sources, some of which are written (such as statutes) and others (such as constitutional conventions), which are unwritten. Constitutional conventions are an important non-legal and unwritten source of the constitution. They may be defined as: "…rules of constitutional behavior …considered to be binding upon those who operate the constitution but which are not enforced by the law courts…nor by the presiding officers in the House of Commons". An example of a constitutional convention is that the monarch always gives Royal Assent to a bill, if advised to do so by the Prime Minister. How many legal systems does the UK have?

The United States has a federal system of government, a written constitution, and a common law legal system, though “legal system” is used here as a term of convenience that encompasses a multiplicity of systems that are linked in often complex ways. There is a legal system for the federal government and there is a separate system for each of the fifty states, for the District of Columbia (the nation’s capital), and for each of the American territories and other overseas possessions. The federal government was established by, and its powers are defined by, the United States Constitution. The individual states have their own constitutions, but the organization of the state governments tends to follow the same general pattern as that of the federal government. The federal legislative body is the United States Congress which consists of the Senate and the House of Representatives. The two houses of Congress have equal power in the legislative process, and all legislation must be passed by both of them. In the system of checks and balances, Congress can refuse to approve Presidential appointments and can override presidential veto. Executive power is exercised by, or under the authority of, the President. The executive branch consists of the President, the Vice President, the Cabinet and the 13 Departments. Its responsibility is to enforce laws. Judicial power is exercised by both federal and state courts. They interpret laws and make decisions in lawsuits.

Almost everything we do is governed by some set of rules. There are rules for games, for social clubs, for sports and for work. There are also rules imposed by morality and custom that play an important role in telling us what we should and should not do. However, some rules – those made by the state or the courts – are called “laws”. Laws resemble morality because they are designed to control or alter our behavior. But unlike rules of morality, laws are enforced by the courts; if you break a law – whether you like that law or not – you may be forced to pay a fine, pay damages, or go to prison. If we did not live in a structured society with other people, laws would not be necessary. We would simply do as we please, with little regard for others. But ever since individuals began to associate with other people – to live in society – laws have been the glue that has kept society together. Even in a well-ordered society, people have disagreements and conflicts arise. The law must provide a way to resolve these disputes peacefully. We need law, then, to ensure a safe and peaceful society in which individuals’ rights are respected. The legal system should respect individual rights while, at the same time, ensuring that society operates in an orderly manner. And society should believe in the Rule of Law, which means that the law applies to every person. What is our behavior governed by?

Law is a system of rules established by the state. The main aim of law is to consolidate and safeguard the social and state system and its economic foundation. The system of law in our country consists of different categories of law. Constitutional law is a leading category of the whole system of law. Its principal source is the country’s Constitution. It deals with social structure, the state system, organization of state power and the legal status of citizens. Administrative law is closely connected with constitutional law but it deals with the legal forms of concrete executive and administrative activity of a government and ministries. Criminal law defines the general principles of criminal responsibility, individual types of crimes and punishments applied to criminals. Criminal law takes the form of a criminal code. International law regulates relations between governments and also between private citizens of one country and those of another. Financial law regulates the budget, taxation, state credits and other spheres of financial activity. Civil law is connected with relations in the economic sphere of life, with relations involving property, its distribution and exchange. The right in property is the central institution of civil law. The rules of employment law include the legislation on the employment of industrial and office workers and regulate matters arising from employment relations.

The UK has a parliamentary system of governance, with the Westminster Parliament being the supreme law-making body. The doctrine of supremacy of Parliament means that the courts accept that legislation enacted by Parliament takes precedence over the common law (essentially, judge-made law as developed through cases). The head of state is the monarch who is unelected and who occupies that position by virtue of birth. In practice, the role of the monarch is largely ceremonial. The UK Parliament comprises two separate Houses: the House of Commons and the House of Lords. The House of Commons is a representative body. Members of the House are elected. The House of Lords is not elected and is not a representative body. Most members of the House of Lords are life peers appointed by the Monarch on the advice of the Prime Minister. There is no formal separation of powers in the UK constitution, but it is possible to identify persons or bodies that make up branches of the state: The executive branch is made up of the monarch, the Prime Minister and other Government Ministers, the civil service and members of the police and armed forces. The legislative branch is made up of the monarch, the House of Commons and the House of Lords. The judicial branch is made up of the monarch, legally-qualified judges and magistrates (non-legally-qualified members of the public). What is the supreme law-making body in the UK? -: the Monarch -: the Prime Minister +: the Parliament -: not mentionedWho is the head of the state in the UK?
